Miller pleads guilty to sex abuse

A former police officer and school administrator from Leitchfield recently pleaded guilty in U.S. District Court to violating federal and state sex abuse laws.

Stephen E. Miller, 45, pleaded guilty to four counts in a superseding information on Thursday, July 30, and, last week, Chief Judge Joseph H. McKinley, Jr. accepted the plea and scheduled Miller’s sentencing for Monday, Nov. 2 at 11 a.m. in Louisville, United States Attorney John E. Kuhn, Jr. announced on Friday, Aug. 28.

Miller pleaded guilty to engaging in abusive sexual contact with three female students and third degree sodomy with a fourth female student. These incidents occurred at Bluegrass Challenge Academy—where Miller worked in a supervisory position—between Feb. and Aug. 2013, according to a news release from the U.S. Attorney’s Office for the Western District of Kentucky.

Miller previously worked as a police officer in Leitchfield, but he resigned from the position following complaints of inappropriate conduct toward two women, the release states.

Miller then began working at Bluegrass Challenge Academy, a residential, educational program operated by the Kentucky National Guard and located on Fort Knox Military Base. Miller had supervisory authority over the academy students.

According to the superseding information, filed on June 15, 2015, the four counts to which Miller pleaded guilty are as follows:

1.) On or about Feb. 8, 2013, Miller, within the special maritime and territorial jurisdiction of the United States (Fort Knox Military Base) “knowingly engaged in sexual contact with Jane Doe #1, to wit, the intentional touching of [Miller’s] genitalia with Jane Doe #1’s hand, without Jane Doe #1’s permission, with the intent to arouse or gratify [Miller’s] sexual desire.”

2.) In or about and between July 2013 and Aug. 2013, within the special maritime and territorial jurisdiction of the United States (Fort Knox Military Base), Miller “knowingly engaged in sexual contact with Jane Doe #2, to wit, the intentional touch of Jane Doe #2’s breast, without Jane Do #2’s permission, with the intent to arouse or gratify [Miller’s] sexual desire.”

3.) On or about Aug. 7, 2013, within the special maritime and territorial jurisdiction of the United States (Fort Knox Military Base), Miller, “who was then employed as a Cadre Supervisor for the female platoon, which was a ‘position of authority’ and a ‘position of special trust’ as defined by KY. Rev. Stat. 532.045, engaged in deviate sexual intercourse with Jane Doe #3, a minor [whom] had not attained the age of 18 years and [with whom Miller] came into contact…as a result of his position, without her consent.”

4.) In or around Feb. 2013, within the special maritime and territorial jurisdiction of the United States (Fort Knox Military Base), Miller “knowingly engaged in sexual contact with Jane Doe #4, to wit, the intentional touching of [Miller’s] genitalia with Jane Doe #4’s shoulder, without Jane Doe #4’s permission, with the intent to arouse or gratify [Miller’s] sexual desire.”

Miller faces a maximum sentence of 11 years in prison, a fine of up to $1,000,000, and at least five years of supervised release.

John Smith, who was the director of Bluegrass Challenge Academy at the time of these incidents, has also been indicted for failure to report child abuse. If convicted, Smith faces a maximum sentence of one year in prison, a fine of up to $100,000, and up to one year of supervised release.

Assistant U.S. Attorneys Amanda Gregory and Stephanie Zimdahl are prosecuting this case. The Federal Bureau of Investigation, with assistance from the Army Criminal Investigation Division, conducted the investigation.
